Korcula Explorer Terms and Conditions

General

 

These Terms & Conditions govern all bookings with Korcula Explorer.com, which is the trading name for the company Korculanski Avanturisti d.o.o (“we” or “us). The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are currently only available to persons who are at least 18 years of age.

 

Accommodation Reservations

 

These Terms & Conditions come into force after a deposit for accommodation has been paid to and received by Korcula Explorer.

 

Liability:

In consideration of the fact that we act only as a booking agent, we cannot accept any liability whatsoever for any problems or property damage that occurs while guests occupy the Accommodation of their choice.  We accept no liability whatsoever for any aspect of the arrangements including but limited to any services provided by suppliers or Accommodation owners/managers included on this website and in particular, accept no liability of loss, personal injury/illness or death however incurred.

 

Representation of Property:

Although we endeavour to make sure all photographs and information provided about the quality and facilities of the Accommodation displayed on the website are correct, we cannot control or prevent changes to the Accommodation Unit made by the owner/manager. No compensation whatsoever will be payable by us should there be any differences to the Accommodation upon your arrival, to that shown on the website. All Accommodation Units are inspected by us before they are included on the website and any material, structural or other changes to the Accommodation are updated on the website as necessary, once informed by the owner/manager of the Accommodation

 

Availability of Accommodation:

The availability calendar of each Accommodation Unit is based upon information provided by the owner/manager of the accommodation and on rare occasions at the time of you requesting the unit, it may no longer be available for your chosen dates. We will confirm the availability of the Accommodation of your choice, upon receiving your Booking Enquiry Form, with the owner/manager of the Accommodation Unit before confirming your reservation by email. We accept no responsibility should your chosen Accommodation not be available for your selected dates, but will make every effort to suggest alternative accommodation, subject to availability. We cannot be held accountable should the Accommodation owner/manager fails to notify us of dates the accommodation is unavailable. Please note your booking is not guaranteed until we have we have received a deposit payment and sent an Accommodation Booking Confirmation.

 

Making a Booking:

To make a booking, complete in full and submit the Booking Form, including the property reference. Once we have confirmed the availability for a final time with the owner/manager of your chosen Accommodation and you have confirmed you wish to proceed with the reservation, we will send you a Deposit Invoice; the deposit payment being required to guarantee your booking. Please note your booking will not be guaranteed until we have received the deposit and sent you an Accommodation Booking Confirmation.

 

Deposit and Booking Confirmation:

Once a Booking Enquiry has been confirmed by us by email, a non-refundable deposit in Euros is to paid. The exact amount payable will be indicated on the Deposit Invoice, which will be sent to you by email after we have confirmed the reservation with the Accommodation unit owner/manager.

 

All deposit payments must be made via Credit/Debit Card or Paypal. Should payment not be received within 48 hours from the date of invoice, we reserve the right to cancel the booking. Upon request we can also accept Bank Transfer Payments. The payee is responsible for paying any fees applied by the sending and/or receiving banks.

 

After the deposit has been received, we will email you an Accommodation Booking Confirmation which includes the contact details of the owner/manager of the Accommodation unit, full details of your reservation, the final balance amount payable upon arrival at the Accommodation in Kuna and any other useful information. The Accommodation Booking Confirmation must be presented to the owner/manager of the Accommodation Unit upon your arrival, as proof of your reservation.

 

Final Balance:

The final balance of the total accommodation rental price, as shown on the Booking Confirmation, is payable directly to the Accommodation owner/manager on arrival by cash only, (domestic currency is Kuna, some owners/managers may accept Euros but you must confirm this with them). It may be possible to pay the balance prior to your arrival e.g. through bank transfer, but these terms must be agreed with the Accommodation owner/manager.

Additional services that are provided in the accommodation facility but are not included in the rental price (such as food service, use of the washing machine, boat rentals, etc) are additional costs and must be paid directly to the Accommodation manager/owner, at the agreed rate.

 

Changes to your accommodation booking after the check-in date, which is when final balance must be paid, must be addressed to the Accommodation owner/manager. The refund of monies paid (with the exception of the non-refundable deposit paid directly to us) is at the discretion of the Accommodation owner/manager.

 

Arrival at property:

Contact details of the owner/manager of the Accommodation Unit will be included in your Accommodation Booking Confirmation. You must contact the owner/manager to notify them of your arrival time and to arrange check-in and details of receiving the keys.

You are under obligation to arrive at the property with the exact number of people stated on the booking confirmation and if bringing pets having received previous consent from the owner/manager of the Accommodation Unit. Should you not honour these obligations the Accommodation owner/manager can refuse accommodation or request additional payment for the extra guests / pets.

 

Full or Partial cancellation of booking by you:

You can fully or partially cancel your booking at any time; however no refund will be issued by us for any reason whatsoever for the deposit paid for the nights’ cancelled. If the booking is partially cancelled, the deposit paid at the time of the initial booking cannot be applied to the balance of the amended booking. We are not obligated to refund the deposit under any circumstances.

 

Changes to your accommodation booking after the check-in date, which is when final balance must be paid, must be addressed to the Accommodation owner/manager. The refund of monies paid (with the exception of the non-refundable deposit paid directly to us) is at the discretion of the Accommodation owner/manager.

 

We strongly recommend that you take out Travel Insurance in case of cancellation.

 

Cancellation by the Accommodation owner/manager:

We reserve the rights to withdraw or cancel the Accommodation booking due to unexpected circumstances which cannot be avoided or removed resulting in the Accommodation Unit being uninhabitable. In this unlikely event we will try to find an alternative Accommodation of similar quality and cost (any price increase payable by you) or a full refund of deposit paid will be offered.

 

Tourist Residence Tax:

The Croatian Government levies a Tourist Residence Tax which must be paid by all tourists (including Croatian nationals) staying the night. This tourist tax at the current known rate is included in the rates for each Accommodation Unit displayed on the website unless specified otherwise on the individual property description page.

 

Price Changes and Minimum Nights:

We reserve the rights to change the price of Accommodation listed on the website in such cases as where the owner/manager of the rental accommodation changes the price of the unit or when a promotional price is advertised.

If the price of the Accommodation Unti increases after you have requested it via a Booking Enquiry Form but before the deposit payment is made, we are under obligation to inform you of the change and send a revised calculation of the deposit required.

 

In the case where the price increases after the deposit payment has been made, we guarantee that the final balance of the Accommodation will be the same as the initial price quoted on our confirmation email and indicated on the Accommodation Booking Confirmation.

 

If the price of the Accommodation decreases after the deposit has been paid, the customer is not entitled to a new, lower price.

 

Regardless of whether there is a minimum night requirement stated or not on the accommodation description page, the owner/manager has the right to charge a higher rate per night at their discretion. We will advise you as the customer of this new rate and why this higher rate has been applied, before any deposit is paid and any Accommodation is confirmed.

 

Conduct and Property Damage:

It is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to yourself or others or which risks damage to property.

Should you or a member of your party cause damage to the property, the owner/manager of the accommodation unit is entitled to seek reimbursement to cover the cost of the damages and contact the police if the circumstances require it.

 

Air Conditioning:

Whether the cost of any air-conditioning is included in the Accommodation rate or paid for as a supplement, the units must only be used while you are in the property, with all windows and doors kept closed. Under no circumstances must the units be left on continuously while the property is unoccupied.

 

Complaints:

Once an Accommodation Unit has been confirmed and the deposit paid, the owner/manager's details will be provided and you will be liaising directly with the Accommodation owner/manager for pre-arrival arrangements and from arrival at the accommodation unit up until departure. In the unlikely event of a problem with your Accommodation occurring during your stay, you must inform the Accommodation owner/manager immediately so that the matter can be put right. All claims must be addressed directly to the Accommodation owner/manager. As the booking agent, we are not liable or reponsible for any complaints or request for any form of compensation.

 

Exchange rate:

The Kuna price on the Accommodation Booking Confirmation is based upon the Euro to Kuna rate of exchange at Bank of Croatia on the date the Deposit Invoice was issued and is just an approximation of the final balance to be paid. The owner/manager of the Accommodation will inform you of the correct exchange rate when you pay the final balance, which may vary to the amount shown.  We are not liable for any change in the exchange rate between the date the Deposit Invoice is issued and the date the balance is payable.

Other Services Provided and Service Providers (including Tours & Transfers)

 

These Terms & Conditions come into force after a payment for a service has been paid to and received by Korcula Explorer. They are applicable to Korcula Explorer organised tours and any other transfers, tours or excursions we arrage on behalf of and at the request of customers.

 

Payment

To guarantee the booking of any Korcula Explorer organised tour, full payment is required in advance. For other services a non refundable deposit is required. For some some services full payment may be required in advance and you will be notified of the payment conditions upon confirmation of the requested service. An invoice will be sent to you with the amount due & due date, which is payable via PayPal (online credit/debit cards are accepted).

 

Full payment for any service can be arranged upon agreement with us. Please note a full payment fee of 5% of the total amount will be added to the overall total to pay.

 

Cancellation of service by you

A flexible cancellation policy applies for services, dependant on the nature of the service to be provided. Korcula Explorer will inform you of the cancellation policy on the invoice for the requested service. Please ensure you have read this before making any payment.

 

Cancellation of service by Korcula Explorer or Service Provider

Should we or any third party service provider need to cancel any service booked, we will notify you as soon as possible and refund any money paid.

 

Liability

Payment of your deposit or full payment represents your acceptance of all services and arrangements made by Korcula Explorer upon the express condition that Korcula Explorer shall not be liable and does not assume responsibility for any claims, damages, expenses or other financial loss whether to person or property arising out of any injury, accident, death, cancellation, delay, alteration, or inconvenience resulting from any act of omission, commission or inadvertence of any carrier, restaurant or other company or person rendering any of the services included in the arrangements, or caused by weather, sickness, strikes, quarantines or the willful or negligent acts of any other service members or any cause whatsoever beyond the control of Korcula Explorer.

 

To provide some services Korcula Explorer uses third party companies who are independent contractors and not agents or employees of Korcula Explorer. We accept no liability for the acts, errors, representations, warranties, breaches of negligence of any such suppliers or for any personal injuries, deaths, property damage or other damage or expenses resulting from any services they have provided. We have no liability and will issue no refund of monies paid in the event of delay, cancellation, overbooking or any other cause beyond their direct control.

 

Fitness and Travel Insurance

In specific relation to tours and excursions you must be in good health and in reasonably good physical condition. We make every effort to ensure a safe and enjoyable trip, but you should be aware that there are certain risks associated with any type of activity and sometimes accidents do happen. Therefore it is essential that you be covered with travel health insurance, which should cover the cost of all medical assistance that you may require while in Croatia as well as repatriation costs back to your home country.

 

Privacy Policy

Personal information is necessary for the confirmation of the reservation and for further communication. We intend to protect the quality and integrity of your personally identifiable information. We will not provide the personal information of the client to a third party, except to the Accommodation owner/manager or other service providers where we have arranged services on your behalf. We can contact you by email to inform you of any promotional activity that we believe would be of interest to you.
